On the social media site Estatevisit, individuals may contribute own material, enjoy that of others, or do both at the same time. “Creators” are users who publish material, while “Fans” are people who pay to see Creators’ content. This Privacy Notice describes our policies regarding the personal information we get from and use in connection with you. 2. PHYSICAL INFORMATION WE COLLECT 

We gather information known as “personal data” that may be used to identify, contact, characterize, fairly be connected to, or otherwise be related to a specific customer or household. In addition, we could gather non-personal information about you, including aggregated information, that cannot be used to identify you or be connected to you in any other way. This data will be considered as personal data if it is kept alongside or linked to personal data; otherwise, it is not covered by this privacy notice. 

a. Types of Personal Information We Gather 

The kinds of personal information we get from you will vary depending on how you interact with us and use the Services. We gathered the following types of personal data from our users during the last 12 months: 

Real name, alias, postal address, IP address, email address, account name, social security number, license number, passport number, or other similar identifiers are examples of identifiers.

We get your personal information from the sources listed below: 

straight from you. When you directly provide it to us to register an account and use the Services, or when you change the information in your account (for more details, see the section below under “Accessing, Modifying, Rectifying, and Correcting Collected Personal Data”). 

either directly or automatically from you. for instance, as a consequence of your access to and use of the Services. We also record IP addresses and the browser types you use. 

from our suppliers of services. 

d. Legal Foundations of Processing 

We use one or more of the following legal grounds or purposes for processing personal data: 

Execution of a Contract. You have a contract with us under the Terms of Service while using the Services, and we will handle certain personal data in order to fulfill that obligation.

For the purposes of enforcing our Terms of Service, complying with any applicable laws, rules, or regulations, conducting investigations, or taking corrective action, as well as identifying and addressing fraud or security issues, we may process personal data as part of our legitimate business interests. 

Respect for legal requirements and protection of people. We may use personal data to safeguard users of our services and other people, as well as to carry out our legal duties, comply with legitimate legal process, and governmental requests.

In the last twelve (12) months, we have exchanged the following kinds of personal data with third parties for commercial purposes: 

Service providers’ identifiers (such as name, address, email address, government ID, and IP address). 

Other Creators and fans are identified (e.g., by account name). 

Service providers are among the kinds of personal information that the California Customer Records legislation lists (for instance, government IDs and bank account numbers). 

Service providers for information that is audible, electrical, optical, thermal, olfactory, or similar (such as material you generate).

Regarding the gathering and processing of personal data, you have specific rights. If these rights apply to you, you may contact us using the information at the end of this privacy notice to do so, or you can follow the directions in this privacy notice or any communications we’ve sent your way. 

Depending on the laws that apply to you, you may have the following rights: 

the right to information about if and why we treat your personal data;

the right to know where we get the personal information about you that we use;

a. Rectifying, rectifying, and updating the collected personal data 

We make every effort to keep the personal information we gather from you accurate, and if you let us know if anything is incorrect, we’ll endeavor to change our records as soon as possible. However, it is up to you to make sure that the data you provide us is correct, comprehensive, and current and to let us know if anything has changed. Before sending us your information, please double-check it thoroughly. Your account settings allow you to make any adjustments or edits to the information you have provided. 

You may be able to get some personal information in our records from us, depending on the regulations that apply to you. Use the contact details at the end of this privacy notice to get in touch with us if you want to access, review, or modify any personal data you have given us via the Services. In accordance with the terms of any relevant legislation, we retain the right to restrict access. 

b. Your Californian Right to Privacy 

Our users who reside in California may request and obtain from us a list of any personal information (if any) that we disclosed to third parties for their own direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of those third parties, in accordance with California’s “Shine the Light” law. Requests must be addressed to the email address shown below, are free of charge, and are limited to one per person per year. However, we do not provide third parties access to personal information that is shielded from direct marketing by the “Shine the Light” regulation. 

The following extra rights are available to our users who live in California under the California Consumer Privacy Act (“CCPA”). 

Right to Information: You have the right to ask us to provide you with details about the personal information we have obtained, utilized, shared, and sold about you during the last 12 months. This involves asking for any or all of the following information. 

the types of private information gathered about you; 

The types of sources from which we obtained your personal information; The types of personal information about you that we have sold or otherwise made public for commercial purposes; 

types of third parties to whom your personal information was sold or shared with a view to business;

Please be aware that if you request that your personal data be deleted, we reserve the right to refuse your request or to keep any portions of your personal data if doing so is required for us or our service providers to: 

Complete the transaction for which the personal data was gathered, provide an item or service that you requested or that was reasonably expected in light of our continuing commercial connection with you, or in any other way carry out a contract between our company and you. 

Find security issues, prevent harmful, dishonest, fraudulent, or illegal activities, or bring legal action against individuals guilty. 

Debugging seeks to locate and fix faults that interfere with a system’s intended operation. 

Exercise your right to free speech, protect the freedom of another customer to do the same, or utilize another legal right. 

Respect the California Electronic Communications Privacy Act in accordance with Title 12 of Part 2 of the Penal Code’s Chapter 3.6 (beginning with Section 1546).

Any of the aforementioned rights may be exercised from your profile if you have an account with us. You may get in touch with us using any of the ways listed above if you don’t have a profile or if you can’t access, manage, or remove the data in your profile. 

Any genuine consumer request for your personal data may only be made by you or a person you have authorized to act on your behalf. 

Only twice per calendar year may you submit a genuine consumer request for Right to Know or Data Portability. The verified customer request has to: 

Give us enough details so we can fairly confirm you are the person whose personal information we gathered or their authorized representative. Depending on the nature of the request, we may need to confirm your identification using an extra Ondato verification cycle, which calls for a government-issued ID and a picture that necessitates your physical presence (further details are provided below in the identification Verification section). 

Give us enough information about your request so that we can fully comprehend, consider, and address it. 

If we are unable to confirm your identity or have grounds to suspect that the request is fraudulent, we have the right to refuse your request. 

Request from a Consumer by a Licensed Agent 

We need an email addressed to privacy@Estatevisit.com along with the following information whenever any authorized agent files a consumer request on your behalf so that we may identify their identification and establish their legitimacy to act in your place. 

Evidence that you authorized the designated agent to submit the request by signing it. 

Based on the request, enough data to confirm the identity of the authorized agent. 

Depending on the nature of the request, we may additionally need your email address, the last four digits of your social security number, and a valid government-issued ID that hasn’t expired. 

If we are unable to establish your identity or right to make the request, as well as that the personal data pertains to you, we will not be able to reply to your request or furnish you with personal data. Creating an account with us is not necessary in order to submit a genuine consumer request. If you already have a login, however, you must log in in order to make a request. When a customer makes a valid request, we will only utilize the personal information they submit to confirm their identity or right to make the request. 

Within ten (10) business days after receiving the request, we will acknowledge receipt of it. Within forty-five (45) days of receiving a genuine customer request, we shall react to it. If we need longer time (up to 90 days), we will write to let you know why and for how long. We will provide our written answer to that account if you have one with us. We will send you our written answer electronically if you don’t already have an account with us. Any disclosures we provide will only apply to the twelve months prior to receiving the verified consumer request. If appropriate, we will additionally explain in our answer why we are unable to fulfill a request. For requests for data portability, we shall provide the relevant data in a portable and, to the extent technically possible, easily usable format that enables you to send the data to another body without difficulty. 

Unless your request is excessive, repeated, or obviously baseless, we won’t charge you a price to process it or reply to it. Before executing your request, we will let you know why we think the request is justified in charging a charge and provide you an estimate of the cost. 

Your Rights to Privacy in Nevada 

Even if their personal data is not presently being sold, Nevada law allows our users who are Nevada consumers to ask that their personal data not be sold (as defined under relevant Nevada law). Requests may be made without cost by emailing privacy@Estatevisit.com. 

Your Right to Privacy in the UK and the European Union 

Individuals have additional rights regarding their personal data in addition to those mentioned above according to European Union and UK privacy laws. Depending on the circumstances surrounding the processing of personal data, these rights may include: 

the right to object to choices based on automated decision-making or profiling that have an impact on you that is substantial legally or in another way; 

the right to seek a limitation on the processing of personal data or to object to processing of personal data that is being done because (i) of a legitimate interest (including, but not limited to, processing for direct marketing purposes) or (ii) is being done to carry out a task in the public interest; 

the opportunity to request certain personal information we possess on you be sent to you in a machine-readable format, which is known as the right to data portability; and 

You may be able to ask for the deletion or removal of some of the personal information we handle about you under specific conditions, known as the right to erasure and/or the right to be forgotten.

4. YOUR DECISIONS 

You may decide how we interact with you, how we use specific personal data that we acquire about you, and other things. You have the option to refuse to supply information when prompted, but if you do so and that information is required for us to deliver any of our services, you may not be able to access those services. Additionally, you may modify the settings on your browser to prevent some information from being automatically collected. 

Opt-Out of Communications. You can unsubscribe from our email list at any time by clicking the unsubscribe link or other unsubscribe instructions included in any email you receive from us, getting in touch with us using the information at the end of this privacy notice, or adjusting your notification preferences in your account settings. If you would like to opt out, please send an email to the address shown below with the subject line “Opt-Out” and the body including your name and the email address you used to sign up for messages. Please be aware that if you do business with us in the future, you won’t be able to opt out of receiving some automated notifications, such order or subscription confirmations, depending on business transactions (like e-commerce), according to relevant legislation. 

b. Geographical Indications. You may disable location services on your device or reject or withdraw the authorization for certain Services to access location information if you don’t want us to be able to get location information from you. For details on how to accomplish this, please consult the user manual for your operating system or the manufacturer of your device. 

c. Web tracking and cookies. For additional information on how to manage and/or disable certain online tracking technologies, go to our Cookie Notice. 

Protecting personal information five 

To ensure the safety of our systems and the confidentiality, integrity, availability, and resilience of personal data, we use reasonable and suitable physical, technological, and organizational protections. These precautions include (i) encrypting personal data where we think it is necessary (ii) making sure personal data is backed up and is still accessible in the case of a security incident (iii), and (iv) conducting routine testing, assessments, and evaluations of our safeguards’ performance. 

However, no technique of data protection is 100 percent secure. Even while we take precautions to secure personal information, we cannot guarantee that these will be adequate or effective. You should also be aware that data transmission over the Internet is not always secure, and we cannot guarantee that any information you communicate via the Services will be safe. 

6. PERSONAL DATA RETENTION. 

After a user closes their account, we keep their personal information for six (6) months, with some personal information being kept longer if we deem it necessary to carry out the processing activities outlined above, including but not limited to complying with applicable laws, regulations, rules, and requests of relevant law enforcement and/or other governmental agencies, and to the extent we deem it reasonably necessary to protect our rights and the rights of our partners. We are obligated by relevant legislation to keep certain financial data for a period of seven (7) years. 

7. ADDITIONAL IMPORTANT INFO ABOUT PERSONAL DATA AND THE SERVICES. 

Identity confirmation. We provide checks as an option for Fans and require checks for Creators to guarantee that we do not intentionally provide our Services to or collect personal information from anyone under the age of 18 or anyone using a fake identity. These checks include giving specific data to one or more of our service partners, who at the moment authenticate your identification via Ondato, Aristotle, and Jumio. When you start the registration process, you agree that Ondato, Aristotle, or Jumio will receive your personal information and use it in accordance with their privacy policies and terms and conditions, Ondato’s privacy policies and terms and conditions, or Jumio’s privacy policies and terms and conditions. You must provide your passport or another kind of official identification to Ondato, Aristotle, and Jumio, and they all utilize face recognition software to confirm your identity. As part of the verification procedure, Ondato further requests that you provide a picture of yourself carrying your official identity. 

c. Payment Details. Our third party payment partners handle the processing of payments made by Fans to access content. For instance, if you use a payment provider to process your payment, you will provide them your credit card information, expiry date, and security code, which they will handle and keep in accordance with their privacy policies and terms of service. Your whole credit card information, expiry date, and security code are not sent to us. In its place, the payment service provider gives us a “token” that stands in for your account, your card’s expiry date, its type, and the first two and final four digits of its number. The payment provider will also provide us your name and email address if you are asked to give it to them. Estatevisit uses the bank account information that we have gathered and maintained to provide payments to Creators for their material. 

b. Gathering Personal Information from Children. Anyone under the age of 18 is not allowed to use our services. We do not intentionally collect information from minors under the age of 18 and do not authorize anybody under the age of 18 to use the Services. You certify that you are at least 18 years old by using the Services. 

d. Services and Websites from Third Parties. We may refer to or provide links to third-party websites and services for your convenience, including those of unaffiliated third parties, our affiliates, service providers, and other third parties with whom we do business (including, but not limited to, our service providers). You leave our services when you use these third-party services, and we have no responsibility over the content, security, or privacy policies followed by any such websites and services. You do so at your own risk while using these third-party services. Any third-party services are not covered by this privacy notice; for details on how these third-party services gather, utilize, and handle personal data, please consult their privacy notices or policies. 

d. Transfer of a business. We could eventually sell or otherwise transfer all or part of our operations, company, or assets to a third party, whether via a merger, an acquisition, or another method. We reserve the right to disclose any personal information we have collected from or about you through the Services to any prospective or existing third-party acquirers and to include it among the transferred assets. 

Do Not Track, f. We do not now process or adhere to any web browser’s “do not track” signal or comparable methods, nor do we currently employ any cross-site tracking technology. However, keep in mind that our Cookie Notice may provide advice on how to disable or reject certain tracking technologies. 

g. Use internationally. The United States, the European Union, Canada, Hong Kong, Russia, Singapore, Switzerland, Thailand, Ukraine, and the United Kingdom will all keep and/or handle your personal data. By using the Services, you agree that we may transfer your data to and store it in the aforementioned countries, some of which may not have the same data protection laws as your own. Personal data may also be made available as required by law in the aforementioned countries, including to law enforcement and/or national security authorities there. In accordance with Article 46 of the General Data Protection Regulation, we employ data transfer agreements with standard contractual provisions that have been approved by the EU for transfers of data into and out of the European Economic Area. 

8. CHANGES AND REVISIONS TO THIS PRIVACY NOTICE 

All prior information we may have given you regarding our information practices with regard to the Services has been replaced by this Privacy Notice. This privacy notice may be modified, altered, or updated at any time; any such changes, alterations, or updates will take effect immediately upon our publishing of the amended privacy notice. If there are significant changes to our processing practices or this Privacy Notice, we will make a good faith attempt to let you know by publishing a notice on the Services or sending you an email, among other methods. You will be deemed to have accepted the updated Privacy Notice if you keep using the Services after we publish any revised Privacy Notice. 

9. WHERE THIS PRIVACY NOTICE IS APPLICABLE 

The Terms of Service and Acceptable Use Policy that control how you use the Services and this Privacy Notice are subject to each other. Regardless of the method used to access or give information via the Services, this Privacy Notice is applicable. 

Any data that is gathered by third-party services, apps, ads, or websites linked from the Services is not covered by this privacy notice. Under no circumstances are we responsible or accountable for any third party’s compliance with any privacy policies, statements, or practices that apply to the acquisition or receipt of your information by such third parties.
